New Regime vs Old Regime: Which Is Better for Indian Freelancers?
The New Tax Regime is now the default, but is it always better? Here's a detailed comparison specifically for freelancers and self-employed professionals.
Since Budget 2023, the New Tax Regime has been the default tax regime in India. But for freelancers, the choice between New and Old isn't as simple as it is for salaried employees. Your business expenses, deductions, and whether you use Section 44ADA all play a role.
Tax Rate Comparison
| Income Slab | New Regime Rate | Old Regime Rate |
|---|---|---|
| Up to ₹3,00,000 | 0% | 0% |
| ₹3,00,001 – ₹6,00,000 | 5% | 5% |
| ₹6,00,001 – ₹9,00,000 | 10% | 20% |
| ₹9,00,001 – ₹12,00,000 | 15% | 20% |
| ₹12,00,001 – ₹15,00,000 | 20% | 30% |
| Above ₹15,00,000 | 30% | 30% |
The New Regime offers lower rates in the middle slabs — but you lose most deductions and exemptions.
What You Lose in the New Regime
- Section 80C deductions (PPF, ELSS, LIC, etc.) — up to ₹1.5 lakh
- Section 80D (health insurance premium)
- HRA exemption
- Home loan interest under Section 24
- Professional tax deduction
- Standard deduction for business income (though FY 2023-24 added ₹50,000 for salaried)
Real-World Comparison for Freelancers
Here's how the two regimes compare for freelancers at different income levels:
| Gross Income | New Regime Tax | Old Regime Tax (with deductions) |
|---|---|---|
| ₹5,00,000 | ₹0 (with ₹75K std. deduction) | ₹0 (with 44ADA) |
| ₹10,00,000 | ₹62,400 | ₹46,800 (44ADA + 80C) |
| ₹20,00,000 | ₹3,12,000 | ₹2,34,000 (44ADA + 80C) |
| ₹30,00,000 | ₹6,24,000 | ₹5,46,000 (44ADA + 80C) |
Note: Old Regime calculation assumes Section 44ADA (50% deemed income) plus ₹1.5 lakh Section 80C deduction. Actual results vary based on your specific deductions.
When New Regime Is Better
- You don't have significant deductions (no HRA, minimal 80C investments)
- You're in the early stages of freelancing with lower expenses
- Your income is in the ₹6-15 lakh range where the slab difference is biggest
When Old Regime Is Better
- You can claim Section 44ADA AND have additional deductions (80C, 80D, HRA)
- You pay rent and claim HRA (salaried + freelance combo)
- You have a home loan with significant interest payments
- Your income is high enough that deductions make a big absolute difference
