Home Office Tax Deductions for Indian Freelancers
What home office expenses can you claim as a freelancer in India? Here's what's deductible under different tax regimes.
Most Indian freelancers work from home — but many don't realize which home office expenses can reduce their taxable income. The answer depends on which tax regime and method you choose.
Section 44ADA and Home Office
Under Section 44ADA, you declare 50% of your gross receipts as taxable income. You cannot claim additional home office expenses on top of this 50% deemed deduction — the law already assumes your expenses are 50% of income.
However, if your actual expenses exceed 50%, you might benefit from switching to the regular taxation method (not presumptive), where you can itemize all expenses including home office costs.
Deductible Home Office Expenses (Non-44ADA)
If you're not using Section 44ADA, you can deduct:

How to Calculate Business Use Percentage
For shared expenses (rent, electricity, internet), the standard approach is:
- Area method: If your home office takes up 20% of your apartment's total area, claim 20% of rent and utilities
- Time method: If you work from home 8 hours/day (33% of 24 hours), claim 33% of internet and electricity
- Combined: Most accountants recommend the area method as it's easier to justify during assessment
New Regime vs Old Regime for Home Office
Under the New Tax Regime (default from FY 2023-24), most itemized deductions are not available. However, Section 44ADA's 50% deemed income still applies.
Under the Old Regime, you can combine 44ADA with other deductions, or if you're on actual expenses, you can deduct all business-related home office costs.
For most freelancers with low home office expenses (internet + laptop), 44ADA + New Regime is still the most tax-efficient combination.
