SSM Registration for Malaysian Freelancers: Step-by-Step Guide
How to register your freelance business with SSM (Suruhanjaya Syarikat Malaysia) — from sole proprietorship to tax compliance.
If you're freelancing in Malaysia, registering with SSM (Suruhanjaya Syarikat Malaysia) is the first step to legitimizing your business. It's required if you operate under a business name, and it affects how you file taxes and claim deductions.
Do You Need SSM Registration?
Under the Registration of Businesses Act 1956, anyone carrying on business under a name other than their own legal name must register with SSM within 30 days of starting operations.
Examples:
- Using your own name: "Ahmad bin Hassan" — no SSM registration required (but still recommended for tax purposes)
- Using a business name: "Ahmad Designs" or "KL Digital Solutions" — SSM registration required
- Partnership: Any business with multiple owners — must register as a partnership
Sole Proprietorship vs Partnership
| Feature | Sole Proprietorship | Partnership |
|---|---|---|
| Number of owners | 1 person | 2-20 people |
| Registration fee | RM 60/year | RM 60/year |
| Liability | Unlimited personal liability | Joint and several liability |
| Tax filing | Personal income tax (Form B) | Each partner files individually |
| Registration process | Online via SSM e-Info | All partners must be present/consent |
For most freelancers, a sole proprietorship is the simplest and most common structure.
How to Register Online
- Visit SSM e-Info: www.ssm-einfo.my or download the SSM Biz App
- Create an account: Register with your MyKad (IC) number
- Check business name availability: Search to ensure your desired name isn't already taken
- Fill in the application:
- Business name and nature of business (select relevant SSIC code)
- Business address
- Owner details (IC number, address, contact)
- Commencement date
- Pay the fee: RM 60/year (credit/debit card or online banking)
- Receive your registration: You'll get a digital Business Registration Certificate
The entire process takes about 15-30 minutes if done online. Walk-in registration at SSM counters is also available.
Tax Implications After SSM Registration
Once registered with SSM:
- You must file Form B (not Form BE) with LHDN
- You can claim business expenses against your freelance income
- You may need to contribute to SOCSO (PERKESO) as a self-employed person
- Your SSM registration is valid for 1 year and must be renewed annually
Opening a Business Bank Account
With your SSM registration certificate, you can open a business bank account at any Malaysian bank (Maybank, CIMB, Public Bank, etc.). This is recommended because:
- Separates personal and business finances
- Makes tax filing much easier
- Required by some clients and payment platforms
- Professional image for invoicing
Penalties for Not Registering
Operating a business without SSM registration can result in:
- Fine up to RM 50,000
- Imprisonment up to 3 years
- Inability to legally enforce business contracts
- Difficulty opening business bank accounts
